Terms of Service

These terms are a binding agreement between you and Sitepost. By creating an account or using the service, you agree to them.

1. The service

Sitepost is software that discovers local businesses, generates a website for each, produces postcard outreach with QR codes, and tracks the resulting funnel. Features depend on your plan.

2. Accounts & eligibility

You must be at least 18 and authorized to act for any business you represent. You’re responsible for activity under your account and for keeping access to your email secure, since sign-in uses emailed magic links.

3. Plans, billing & trials

  • Free accounts can explore the console but cannot trigger paid actions (live AI generation, live scraping, or postcard mailing).
  • Paid plans are billed monthly in advance through Stripe and renew automatically until canceled.
  • Any free trial converts to a paid subscription unless canceled before it ends.
  • Prices exclude taxes where applicable. You authorize us (via Stripe) to charge your payment method.
  • You can cancel anytime; see our Refunds & Cancellation policy.

4. Acceptable use & your responsibilities

You must follow our Acceptable Use Policy. Importantly, when you run outreach you act as the data controller for the businesses you target. You represent that you have a lawful basis to contact them and that your campaigns comply with all applicable laws — including CAN-SPAM, CASL, the TCPA, postal regulations, and the GDPR/UK GDPR where relevant — and that you honor opt-out and do-not-contact requests.

5. Content & intellectual property

We grant you a license to use the websites and materials generated for your campaigns. You own the business content you provide. Sitepost retains all rights in the platform, software, and brand. AI-generated output is provided for your review — you are responsible for verifying its accuracy and right to use before publishing.

6. Third-party services

The service relies on third parties (e.g. Stripe, Google, Lob, Anthropic, Resend). Your use of those features may be subject to their terms, and we’re not responsible for their acts or omissions.

7. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind. We don’t guarantee specific results, response rates, revenue, uptime, or that AI-generated content will be accurate or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Sitepost will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Indemnification

You agree to indemnify and hold Sitepost harmless from claims arising out of your use of the service, your campaigns and outreach, the data you process, and your breach of these terms or any law.

10. Termination

You may stop using the service and cancel anytime. We may suspend or terminate access for breach of these terms or the Acceptable Use Policy, or where required by law.

11. Governing law

These terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules, except where your local consumer-protection law provides otherwise. Disputes will be resolved in the state or federal courts located in Utah.
